Abstract

Medical malpractice is aphysician ,s deviation from the applicable standard of care that a similar physician would exercise under the same circumstances. Proving medical malpractice almost always requires the testimony of an expert witness in the samefield of practice as the alleged negligent health care worker. In a typical medical malpractice claim, four elements must be proven :(1 A relationship must exist between physician and patient so that a duty of due care was created. 2)Breachof the standard of care which is a mistake thata a reasonable and prudent doctor would not have made under the same circumstances. 3) Caustion: proof that the injury would not have occurred but for the doctor ,s mistake; and 4)Injury, in the form of lost wages, medical bills, agony, mental suffering or death However, it is important to note that if an injury results while the doctor was following the standard of care, then a medical malpractice suit will not succeed. Legal actions for negligence can be within the civil or criminal law. The aim of this study was to throw light on medical malpractice claims in middle delta region. This might show physicians where the greatest risks of malpractice, in every specialty, are, and steps and strategies that should be taken to reduce their exposure.
