المستخلص The subject of this study is “The civil responsibility of a judge”, and it consists of four main chapters preceded with introductory Chapter. The researcher in this chapter discussed the definition of the judiciary and its necessity, and criminal and disciplinary responsibility of the judge, also the relationship between the various responsibilities generated by error attributed to them. The first chapter includes what the civil responsibility of the judge is and its historical and legislative development. The second chapter deals with the elements of this responsibility which are the wrong (cases of the legal base of responsibility), damage and causal relationship between them. The third chapter discussed basis of personal responsibility of the judge, and the range of state responsibility for their actions, also the legal basis which it depends on. The fourth and final chapter presents the implications of this responsibility, explaining both sides of the claim of responsibility, the competent court to its consideration, appointment filed, procedures, judgment, and how to appeal. This study concluded by displays the most important findings and recommendations reached. |
