After having completed by praise of God from the completion of the thesis entitled ”Transitional Justice in modern constitutional systems (comparative study with the application on Iraq),” which is one of the most important subjects at the global and Arab level. where we started in the first chapter, entitled ”Justice , the conceptual and theoretical framework for transitional justice” and that it includes three sections. In the first section, we addressed the transitional justice as a part of justice where the general meaning of the concept of justice, and the significance of the concept of transitional justice, and the designation of transitional justice, and its definition, and historical evolution of the concept of transitional justice, while in the second section, we dealt with the subject of transitional justice: literature of law and influencing factors, where we dealt with the topic of transitional justice in the literature of law and political factors that have boosted the importance of transitional justice. Whereas in the third section, we dealt with the strategies for transitional justice and it has included key strategies such as truth, compensation committees and reparations and institutional reform and it included optional strategies such as accountability , trials and that there is no impunity and national reconciliation as a way of civil peace as well as cleansing and establishing memorials and the revival of collective memories. We dealt in the second chapter, within the first section with transitional justice applications in modern comparative constitutional systems which included transitional justice in international experiences and it included the transitional justice in Europe such the experience of Germany and the experience of Poland, as well as transitional justice in Africa, and we pointed to the experience of Sierra Leone and the experience of South Africa,. Moreover, we addressed the Transitional Justice in Latin American countries, such as the experience of Argentina and the experience of Guatemala.as for the second section, we addressed the Transitional justice in the Arab countries and it included the Moroccan experience as a model for transitional justice by the Arab spring and the Tunisian experience as a model for transitional justice for the countries of the Arab spring As for the third chapter, we addressed the transitional justice in the Egyptian experience and the first part included the theoretical foundations of transitional justice in Egypt and we addressed the democratization and transitional justice and the legacy of the past and the causes of the revolution, as well as the former regime’s policies in violation of human rights. The second section, it addressed the terms of the fundamentals of transitional justice in the Egyptian experience. Thus, we addressed through it the citizenship and the standard belonging to the revolution in January and social justice as a part of transitional justice while we discussed in the third section , the subject practical and applied procedures for transitional justice in Egypt and we addressed strategies of truth commissions and cleansing and tribunals and truth and cleansing commissions and political isolation as well as the trials and we dealt with the subject of issuance of a new constitution in transitional justice stage as well as the executive institutions of transitional justice, such as the Ministry of justice and the national transitional Council to take care of the families of martyrs and injured.
