The modern era has witnessed many changes that have faced many difficulties in the face of the enormous civilizational dimension in contracting. The third revolution, the information revolution, has alerted many to the danger of imbalance and inequality among the common interests. Hence, in the field of legal studies, Are unable to cope with these difficulties because of the urgent need to stabilize transactions between contracting parties. The contract is governed by contractual justice and mutual legitimate trust between contractors. The concept of commitment to cooperation has been echoed in many judgments of the French judiciary since the beginning of the last century, allowing us to say that those provisions formed the first roots of this obligation. However, those judicial provisions, while reaffirming the obligation to cooperate and arranged binding legal effects on the parties, In the light of secondary commitments to ensure the optimal implementation of the contract, and the fact that the jurisprudence of this obligation was limited to the assertion of its necessity at the stage of implementation of the contract, To which he is entitled, in the whole, which is derived from the provisions of the French judiciary. Because of the continuous development and complexity of economic life and financial transactions, many problems have been created that have been reflected on the decade. Therefore, we find that the Egyptian and Libyan courts are compatible with the basis of the law for the obligation to cooperate in article 148/1 Egyptian civil, Libyan civil ”contract must be executed in accordance with the contract included in a manner consistent with what is required by good faith.
