Education is a necessity for the development and survival of both the individual and the society. Thanks to education, we can fulfill our duties and practice our rights. It is an indispensably fundamental human right. it is important to place emphasis on the right of all citizens to be educated but in accordance with their abilities and potentials. By implication, the right to an education rests on the State’s commitment to provide education for all citizens as one of its most important duties. Indeed, educational policy ,in any educational system, represents the basis that guides and regulates the system as a whole. Recently, the analysis of educational policies as an area of educational research has attracted an increasing attention for they represent the pillar of development achieved through promoting both of the individual and the society intellectually, culturally, behaviorally, economically and architecturally. Yet, the elements of educational policy, by consensus, are still far from the criteria of the standard educational policies. Such is the reality of the educational policy in general and it is even much worse as ‘the disabled’ are concerned. In view of the foregoing, there is a gap between laws and legislation for the educational rights of the disabled on one hand and the actual application of these laws on the other hand. Such a gap resulted in depriving the disabled of their educational rights to have equal opportunities in education. Accordingly, this research strives to investigate how the educational rights of the disabled can be enhanced in light of their legislative framework reflected in the current educational policy.
