The economic, industrial and technological developments that our era is witnessing have led to the emergence of the phenomenon of commercial fraud in a large scale and widespread; As these developments helped many producers and merchants to produce products and commodities that do not comply with the specifications and standards concerned by the competent authority, as well as the manipulation of trademarks or commercial data placed on the products or the use of misleading commercial advertisements to delude the public of consumers, in order to achieve certain financial profits. Regardless of the benefit to consumers and users of those goods and products. As a result of the spread of the phenomenon of commercial fraud, which has become a scourge of contemporary society, the practical reality has revealed that traditional legal methods are not sufficient to confront the phenomenon of commercial fraud and achieve the desired protection for all consumers, and this leads us to the need to demand the establishment of a special legal system that meets the requirements of consumer protection from all kinds of fraud and deception The commercial who might attack him. Based on what has been mentioned above, we have dealt with in this study the topic (legal protection of the consumer from commercial fraud) a comparative study. On a research plan that contains two chapters: each chapter is divided into two sections, where we discussed in the first chapter what is consumer protection and commercial fraud. In which we demonstrated the legal concept of the consumer and its development, as well as the concept of commercial fraud and a picture. In the second chapter we dealt with the legal means to protect the consumer from commercial fraud, in which we explained the contractual provisions for consumer protection represented in obliging the producer to inform the consumer about the descriptions related to the commodity, and a mark with all the details of the contract, as well as a mark for the right to withdraw from the contract during a certain period of time. Defective products, what is their nature, and who are their parties. Then, in the conclusion, we presented the findings and recommendations that we invite the legislator to take into account.
