Judicial oversight of disciplinary sanctions is considered the true artist and money of protection as a means of legitimacy. Also, disciplinary decisions issued by the administrative authorities are subject to the control of the administrative judiciary in decisions. Issued by imposing the disciplinary penalty on the employee, which are administrative decisions that are subject to the control of the administrative judiciary in accordance with the legal system and the court competent to consider cases in the disciplinary decisions that are subject to the imposition of the penalty, which is the Supreme Disciplinary Court, and the Staff Court, whether in Egypt or Iraq, so that control has become strict on the part of the judiciary, which achieves Justice and fairness within the framework of the job taking into account the Saban that the Administrative Judiciary Court went to choose the punishment navigation the disciplinary error committed .. the general with The disciplinary penalty is also a means of the authority to ensure respect for the legal rules and the achievement of the functioning of public systems and utilities. The imposition of penalties is not among them, as it violates the principle of the legality of punishment, and since the disciplinary penalties imposed on the employee affect his career and have effects related to his future and salary; Therefore, the legislator was not late in informing him or specifying his giving of imposing disciplinary penalties from the controls and guarantees to achieve this goal, whether in Iraq or Egypt, which represents this guarantee, whether it was previous, contemporary, or subsequent in the issuance of disciplinary decisions or judgment in disciplinary cases, and the aim of throwing these guarantees It is to achieve a balance between the interests of the administration and the employee at the same time, in order to ensure the justice of the penalties, and to create reassurance in the soul of the accused, and to avoid the semi-half and the abuse or abuse of authority in terms of the disciplinary authorities.
