Praise be to God, Lord of the worlds, and prayers and peace be upon the seal of the messengers, our master Muhammad bin Abdullah, the chosen prophet of God, and his beloved chosen one, and his family and companions, everlasting prayers and peace until God inherits the earth and whoever is on it, and He is the best of the inheritors, and after,,,Illegal immigration represents an explicit violation of human rights, and it has turned into a phenomenon of global dimensions, as criminal networks exploit the conditions of vulnerable groups of individuals such as children, women, and the poor in displacing them from poor countries to rich countries in search of a better life, and they are sometimes exploited in illegal activities. Legal, such as prostitution and slavery, and since man began his life on earth, he has been trying as much as he can to live securely and reassuringly, nothing terrifies him, and no obstacle stands between him and what he seeks of affluence and happiness. Therefore, the efforts of philosophers and scholars of different specializations increased whenever its number multiplied, its members multiplied, and its problems became more complex and diversified.In view of the negative effects and consequences of this phenomenon, it has become the preoccupation of a number of national governments and regional and international institutions and organizations to work to combat and reduce it, and the Libyan legislator believes in the seriousness of the danger of the phenomenon of illegal immigration to Libya, as it is a destination for the majority of those who wish to emigrate from the African countries. to the attractive European countries; Because of the length of its common borders with the first and its proximity to the second; Which made it a transit country, and for a large number of illegal immigrants, it singled out a special law to deal with it, and established courts specialized in illegal immigration crimes.Our study of the subject of the research will be limited to the legislation in force at the present time, namely Law No. (82) of 2016 AD, regarding combating illegal immigration in Egyptian law, and Law No. (6) of 1987 AD regarding the entry and residence of foreigners in Libya and their exit from it and its amendments, and Law No. (19) for the year 2010 AD, regarding the fight against illegal immigration, given that the legislation that preceded it is considered from the past, which there is no benefit in studying it except as a reminder of it only.The importance of this study is evident in understanding and analyzing the phenomenon of illegal immigration, and knowing its size, causes and various effects, whether positive or negative.The importance of the topic also appears in that most of the illegal immigrants are unable to provide for the needs of their homes due to flight, violence, and the economic and political problems that their countries suffer from. The importance also follows from the fact that immigrants are exposed to the phenomenon of illegal immigration provisions in national and international law and their effects on societies and the extent of their legitimacy.Therefore, the researcher does not seek in this work a comprehensive treatment or a general evaluation of migration in all its aspects, but rather we seek to give a view on the illegal immigrant; Therefore, our study will be limited to the legal framework of the illegal immigrant and the extent of his responsibility and protection from punishment, and to present proposals and recommendations to address and combat the phenomenon of immigration, whose origin dates back to distant years.The phenomenon of illegal immigration is one of the most important issues that occupies the forefront of international and national concerns, especially in light of the global trend towards economic globalization and the liberalization of trade restrictions. This requires opening borders and easing restrictions on goods and the movement of capital, and the resulting economic and social effects on developing countries. And the poor, these negative repercussions contributed greatly to the emergence of an increase in the pace of illegal immigration towards developed countries in order to create better living conditions for individuals
