Acquiring the property of real estates in their different forms via appropriation raises many problems some of which are related to appropriation in itself and some are related to its effects against the landlord and against third parties as well as other practical problems connected with the opposition of the principal landlord. In additions, the problems get more complex in case the latter is the stator or one of its judicial persons.
Also, a problem of how the appropriating person owns that real estate arises out of acquiring the property of these real estate’s via privation in case there wasn’t a dispute by the principal landlord after satisfying the conditions of ownership via appropriation.
Also owning the real estates via propriatem is considered to be a spaical problem in case the lands are poor or capable of being reclaimed under the provisions of he law No 143 of 1981 and this research is uniquely connected with the practical problems in courts and comaring them scientifically with the successive legal exts starting from acquiring the property through appropriating it and cultivating it in accordance with Article 874 of the civil code paragraph 3 or Article 1813 of the law no 143 of 1981 on the desert lands.
Appropriation is a dual fact in which it is a physical act mixed with the will of the appropriating person to own at once and that is a voluntary element. But the physical element here is prevalent and therefore, appropriation was attached to the physical facts.
