Woman is considered to be a fundamental support in family and society structure Islamic sharia took care of her, and granted woman all her rights, and personal affairs laws made an effort to achieve that,
So the study would shed the light upon searching the subject of women’s rights in Islamic sharia and personal affairs laws in Egyptian society on the theoretical level and Beni-Seuf courts for personal affairs in the field investigation, as the importance of the study will be cleared through the increasing of rates of cases, which are introduced by women for the courts of personal affairs and the suffering which they face to reach their legal rights.
The examiner used content analysis, and case study method, in order to be able to answer the questions of the study and to achieve its goals, she depended on interview, observation, official records and files as tools to collect the data of the study.
The study consists of three chapters, includes eight parts, and a conclusion.
The first chapter discusses women’s rights from critical vision, which includes three parts, part one deals with women’s Islamic rights as it is defined by Islamic family laws ( Sharia ) and decided by international conventions. And it defined some of the basic concepts, part two includes the theoretical directions in the study of women’s rights, part three displays the previous studies.
The second chapter deals with the law from a sociology prospective, and it includes three parts, part four is a sociology analysis of the law, part five consists of a critical vision for personal affairs laws, part six displays the status quo for the personal affairs laws as it included a sociology analysis for the khala law (women right to divorce).
The third chapter of the study includes the methodical frame of the study, as it included two parts, part seven includes the procedures of the investigation field study, part eight displays the cases of the study and includes a sociology analysis for the cases to answer the question of the study, followed by statistical analysis for the cases.
The study is finished to reach a group of conclusions and recommendations, it can be summarized in that Islamic shaia honored woman, and granted her all her legal rights, and the personal’s affairs laws made an effort to practice that, but there are a group of factors interference, and prevents from seeking women’s rights , as it is assured by many evidences, the existence of differences between the texts of the laws and its practice.
